Cringely asks why Apple failed to conclude talks with Cisco before moving forward, noting that the latter had no choice but to sue if it wanted to defend itself against future infringements. The situation is compounded by the fact that Apple did change the name of the iTV, enabling the company to avoid potential legal troubles with Elgato Systems, makers of the similar EyeTV. The commentator asks why Apple would knowingly challenge a larger company while side-stepping a smaller one, surmising that the move is a calculated publicity stunt designed to earn a great amount of media attention without paying for the equivalent advertising campaign. Cringely also wonders about the choice of Cingular as the carrier partner. The company's 2G network can't maximize the potential of the iPhone, he says, and the 3G network features Cingular Video, a download service that uses RealVideo. Since Apple would prefer customers to use QuickTime and iTunes, the 3G network will go unused until Cingular caves in or loses the partnership. Apple's move may be a direct attempt at domination of cellphone content, Cringely surmises, forcing a major carrier to switch formats if it wants to hold on to a lucrative product. When the Cingular exclusive ends, subsequent carriers may need to support iTunes to retain any popularity. |

An official statement issued by the company to its spokespeople flatly denied the legitimacy of the suit filed in federal court on Wednesday, characterizing Cisco's filing as both "silly" and "tenuous at best." "We're the first company to ever use the iPhone name for a cellphone," the statement said. "If Cisco wants to challenge us on it, we're very confident we'll prevail." In contrast, Cisco representatives have followed their own official statement with relatively candid responses, adopting an at once conciliatory and defensive tone. The network supplier maintained that it had no hostile intent against Apple and was merely protecting what it believed it rightly owned. Speaking with the Wall Street Journal, spokesman John Earnhardt expressed hopes that the lawsuit would not need to continue. "We still hope we can reach an agreement," he said, "but when your neighbor steals your property, you have no recourse other than to call the cops and file a complaint." Cisco senior VP Mark Chandler was equally quick to defend his employer's approach in his corporate blog. He reiterated the company's formal claim that it has owned the iPhone trademark since 2000, following the buyout of an Internet phone developer named Infogear Technology, and that it had no financial or idealist grudges against its purported competitor. Infogear first registered the trademark in 1996. "This is not a suit against Apple?s innovation, their modern design, or their cool phone. It is not a suit about money or royalties. "We're the first company to ever use the iPhone name for a cellphone," he told the WSJ. "If Cisco wants to challenge us on it, we're very confident we'll prevail." On Wednesday, Cisco filed for an injunction to prevent Apple from using the iPhone name, which is currently used for VOIP-based devices from its consumer wireless division. The companies were reportedly on the verge of an agreement after several weeks of negotiations. "Intellectual property is the lifeblood of Silicon Valley and we all have to protect our property. The iPhone trademark is owned by Cisco, as noted in your story," a Cisco spokesperson told the WSJ. "We?ve assumed modest share with Cingular?s 58 million subscribers (starting at 0.35 percent share rolling up to 1.75 percent share through the end of 2008) and very modest share of the estimated European market (250 million subs) and Asian market (1 billion subs)," she wrote. The analyst on Thursday raised her revenue and earnings-per-share (EPS) estimates slightly for Apple's 2007 fiscal year, from revenue of $24.4 billion to $27.3 billion and EPS from $2.84 to $2.85. For fiscal 2008, she raised her revenue estimate from $27.4 billion to $29.4 billion and EPS from $3.18 to $3.47. Ebeling also raised her price target on shares of Apple from $93 to $100. |
